Privacy policy

This is a translation. In case of any discrepancy, only the German version of this privacy policy is legally binding.

This privacy policy explains which personal data we process when you use our website www.mx-academy.ch, register for courses, subscribe to our newsletter or contact us. The Swiss Federal Act on Data Protection (FADP) applies.

2. Visiting the website

When you visit our website, technical data is automatically transmitted to the server and stored in log files: IP address, date and time, page visited, previously visited page (referrer), browser and operating system. We need this data to provide the website, to ensure its security and to fix errors.

Our website is hosted by METANET AG in Zurich (Switzerland). The log files are rotated automatically and deleted regularly.

3. Contacting us

If you contact us by e-mail, phone or via a form, we process your details (e.g. name, e-mail address, phone number, content of your enquiry) in order to answer your request.

4. Course registration

For registrations for courses and events, we process the details in the registration form (e.g. name, address, e-mail, phone, selected course, details of the participants such as height and riding experience, and for children the details of the parents or legal guardians). We use this data to run and invoice the courses, to choose a suitable motorcycle and suitable equipment and to communicate with you. The registration data is stored on our server.

You pay the course fee on site; no payment data is collected via the website.

We keep the data for as long as necessary to run the course and as required by statutory retention obligations (in particular for accounting records).

5. Vouchers

Course vouchers are sold by MX-Academy AG. Orders and payments are handled in our online shop 4motocross.ch, which our voucher page links to; the privacy policy of the shop additionally applies to the processing of order and payment data in the shop. Alternatively, you can order a voucher by bank transfer and e-mail to info@mx-academy.ch; in that case we process your details (name, address, e-mail, amount) to issue and send the voucher.

6. Newsletter

If you subscribe to our newsletter, we store your name and e-mail address in order to send you information about courses, offers and news. Subscriptions and the subscriber list are managed with the software AcyMailing on our own server. For sending, we use the e-mail delivery service turboSMTP of eDisplay Srl. The provider operates servers in Europe, the USA and other countries and states that it complies with the requirements of the European General Data Protection Regulation (GDPR). You can unsubscribe at any time via the unsubscribe link in every issue or by e-mail to info@mx-academy.ch.

7. User account

To register for courses, you create a user account on our website. For this we process the necessary details (e.g. name, user name, e-mail address, password in an unreadable, encrypted form) to manage access.

8. Chat assistant (artificial intelligence)

A chat assistant is available to you on our website. It answers questions about our offers automatically using the AI model «Claude». The provider is Anthropic PBC, 548 Market St, PMB 90375, San Francisco, CA 94104, USA; the contracting party for customers in Switzerland is Anthropic Ireland, Limited (Ireland).

Which data is processed? Your entries in the chat, the conversation history of the current session and the address of the page on which you use the chat. Please do not enter any particularly sensitive personal data in the chat (e.g. health information, ID, account or card numbers).

Purpose: Answering your questions about our offers and improving the answers.

Disclosure abroad: To generate the answers, your chat entries are transmitted to Anthropic and are also processed in the USA. The transfer is based on the standard contractual clauses of the European Commission including the adaptations for Switzerland (Swiss Addendum), which form part of the Data Processing Addendum of Anthropic.

Storage period with us: We store the question, answer, page address and time – without IP address – for 90 days in order to improve the quality of the answers. To protect against misuse (limiting the number of messages), your IP address is stored only in pseudonymised form (hash value) for a maximum of 2 days. The conversation history is also stored in your browser (session storage) until you close the tab or browser window. The chat does not set any cookies.

Voice input: If you use the microphone function, speech recognition is carried out by your browser. In Google Chrome, the recording is transmitted to a web service for this purpose. Use of the microphone function is voluntary.

Note: The answers are generated automatically and may contain errors. Only information and confirmations from MX-Academy AG are binding.

9. Cookies and similar technologies

Our website uses cookies and the storage of your browser:

  • Technically necessary: session cookie of the content management system (Joomla), a cookie after subscribing to the newsletter (so that the newsletter window no longer appears), a marker for the cookie notice as well as settings of image galleries (sliders) in the local storage and the conversation history of the chat (see section 8).
  • Analytics and advertising: cookies of Google Analytics and Google Ads (see section 10).

You can refuse or delete cookies in your browser settings and prevent data collection by Google as described in section 10. If you disable cookies, some functions of the website may not work fully.

On your first visit, a notice informs you about the use of cookies and about this privacy policy.

10. Google services

We use the following services of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, and Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA («Google»):

  • Google Tag Manager: manages the integration of Google Analytics and Google Ads.
  • Google Analytics: analyses the use of our website statistically (e.g. pages visited, time spent, device, approximate location) so that we can improve our offer. Cookies are set for this purpose.
  • Google Ads (conversion tracking and remarketing): measures the success of our advertisements and makes it possible to show visitors of our website suitable advertising on Google later. Cookies are set for this purpose.
  • Google Maps: shows our location on an embedded map.
  • YouTube: embedded videos in privacy-enhanced mode (youtube-nocookie.com). According to Google, playback in this mode is not used to personalise the YouTube service or advertising outside our website. The player is only loaded when you scroll to the video.
  • Google Fonts: fonts are loaded from Google servers.

When these services are used, data such as your IP address and information about your visit is transmitted to Google and may be processed in the USA. More information: policies.google.com/privacy

Options to object:

11. Links to social networks

Our website contains links to our profiles on Facebook, Instagram and YouTube. No plugins of these networks are integrated; data is only transmitted to these providers when you click on a link. The privacy policy of the respective provider then applies.

12. Disclosure abroad

Personal data may be disclosed to the following countries:

  • Ireland (EU): Google Ireland Limited and Anthropic Ireland, Limited. Switzerland recognises data protection in the EU member states as adequate.
  • USA: Google LLC (Google services) and Anthropic PBC (chat assistant). For companies certified under the Swiss-U.S. Data Privacy Framework, an adequate level of data protection has applied since 15 September 2024; otherwise we rely on standard contractual clauses.
  • Newsletter delivery: When sending via turboSMTP (eDisplay Srl), data may be processed in the countries in which the provider operates servers (Europe, USA and other countries).

13. Retention

We keep personal data only for as long as necessary for the purposes described or as required by statutory retention obligations. After that, it is deleted or anonymised.

14. Data security

We take appropriate technical and organisational measures to protect your data. Transmission on our website is encrypted (HTTPS).

15. Your rights

Within the framework of the data protection legislation, you have in particular the right to request information about your personal data, to have incorrect data corrected and data deleted, to object to the processing and to request the release or transfer of your data. To do so, please contact info@mx-academy.ch. We may ask for proof of your identity.

We may amend this privacy policy at any time. The version published on this page applies.
